1. Introduction

Prolean Wellness Management LLC DBA Prolean Wellness ("Prolean Wellness," "we," "us," or "our") operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Prolean Wellness is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, interact with our content on third-party platforms, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.

Scope. This Privacy Policy applies to our e-commerce Services at shop.proleanwellness.com and to our marketing activities. It does not apply to protected health information created or maintained by the Prolean Wellness clinic in connection with clinical care, which is governed by HIPAA and by the clinic's separate Notice of Privacy Practices. See Section 12.


2. Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you.

We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details — your name, address, billing address, shipping address, phone number, and email address.
  • Financial information — payment card information, financial account information, transaction details, form of payment, and payment confirmation. Full payment card numbers are processed and held by our payment processors and are not stored on our systems.
  • Account information — your username, password, security questions, preferences, settings, and subscription status.
  • Transaction information — the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel; your past transactions; your subscription history; and your rewards balance.
  • Wellness preference information — responses you provide to our "Find Your Supplements" tool, product interests, wellness goals you choose to share with us, and product reviews you submit.
  • Communications with us — the information you include in communications with us, for example when sending a customer support inquiry by email, text message, or social media.
  • Device information — information about your device, browser, or network connection, your IP address, mobile and advertising identifiers, and other unique identifiers.
  • Usage information — information regarding your interaction with the Services, including how and when you interact with or navigate the Services, pages viewed, referring URLs, and interactions with our advertising.
  • Inferences — predicted preferences, product affinities, and audience segments we derive from the information above.

Sensitive personal information. Depending on where you live, some information we process may be considered "sensitive," including your account log-in credentials and, in some jurisdictions, information that could reveal health conditions or interests. We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law, and we do not use it to infer characteristics about you. See Section 8 for how we handle consumer health data.


3. Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you — when you create an account, place an order, complete our supplement-matching tool, subscribe to emails or text messages, submit a review, communicate with us, or otherwise provide us with your personal information.
  • Automatically through the Services — from your device when you use our products or services or visit our websites, and through the use of cookies, pixels, software development kits, and similar technologies described in Section 5.
  • From our service providers — including when we engage them to enable certain technology and when they collect or process your personal information on our behalf.
  • From advertising and social media platforms — including Meta, Google, and TikTok, which may provide us with aggregated campaign measurement, audience insights, and, where you have engaged with our content or advertising, limited interaction data.
  • From creators and affiliates — individuals participating in our influencer, affiliate, ambassador, or product-seeding programs may provide us with content, and the platforms they post on may provide associated performance metrics.
  • From our partners or other third parties.

4. How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, process your payments, fulfill your orders, remember your preferences and items you are interested in, send notifications to you related to your account, process purchases, returns, exchanges or other transactions, create, maintain and otherwise manage your account, arrange for shipping, facilitate returns and exchanges, administer your subscriptions, enable you to post reviews, and create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.

Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services and on other websites and platforms — including Facebook, Instagram, Google, YouTube, and TikTok — including based on items you previously viewed, purchased or added to your cart and other activity on the Services. Section 5 explains how this works and how to opt out.

Rewards and Subscriptions. We use your personal information to administer our rewards program, calculate and apply your rewards balance, and manage subscribe-and-save enrollments, renewals, and cancellations. See Section 11.

Product Safety and Quality. We use order and contact information to trace product lots, contact customers in the event of a product recall or quality issue, and meet our recordkeeping obligations as a seller of dietary supplements.

Security and Fraud Prevention. We use your personal information to authenticate your account, provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and secure our Services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.

Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you, and to maintain our business relationship with you.

Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.

We do not use your personal information to make decisions producing legal or similarly significant effects about you through solely automated means.


5. Cookies, Tracking Technologies, and Advertising Partners

We and our partners use cookies, pixels, software development kits, server-side event APIs, local storage, and similar technologies to operate the Services, remember your preferences, measure performance, and deliver and measure advertising.

5.1 Categories of technologies we use

  • Strictly necessary — required to operate the store, maintain your cart and session, and secure checkout. These cannot be disabled.
  • Analytics and performance — help us understand how the Services are used so that we can improve them.
  • Marketing and advertising — used to build audiences, deliver personalized advertising, and measure advertising performance across websites and apps.

You can manage non-essential cookies at any time through our cookie banner or the "Cookie Preferences" link in our website footer.

5.2 Advertising and analytics partners

We work with the partners below. Each acts as an independent controller or business for certain processing and maintains its own privacy policy governing the information it receives.

Meta Platforms, Inc. (Facebook, Instagram). We use the Meta Pixel and, where enabled, the Conversions API to measure advertising performance, build custom and lookalike audiences, and deliver personalized advertising. Where Advanced Matching is enabled, contact information such as your email address or phone number is hashed — converted into an irreversible scrambled value — on our systems before transmission, and used by Meta to match your activity to a Meta account. Google LLC (Google Analytics, Google Ads, Google Merchant Center, YouTube). We use Google Analytics to understand how the Services are used, and Google Ads services including remarketing, conversion tracking, and, where enabled, Enhanced Conversions and Customer Match, which use hashed contact information to measure and target advertising. We implement Google Consent Mode so that Google tags adjust their behavior according to your consent choices. We do not send Google information that personally identifies an individual, such as unhashed email addresses or names, in URLs or as event parameters. We do not use Google advertising products to target users based on sensitive categories, including health conditions, in any manner prohibited by Google's Personalized Advertising policies. TikTok Inc. / TikTok Pte. Ltd. We use the TikTok Pixel and, where enabled, the Events API to measure advertising performance, build audiences, and deliver personalized advertising on TikTok. Where Advanced Matching is enabled, contact information such as your email address or phone number is hashed before transmission and used by TikTok to match activity to a TikTok account. We use these tools in accordance with TikTok's Business Products (Data) Terms and Advertising Policies. If you purchase our products through a social commerce feature such as TikTok Shop, that platform collects and processes your order and payment information directly, under its own privacy policy and terms. 5.3 Other service providers

We also use the following providers, which process personal information on our behalf in order to operate our store:

  • Shopify — e-commerce platform, checkout, hosting, and store analytics.
  • Klaviyo — email and text message marketing delivery and analytics.
  • Appstle — subscription and recurring order management.
  • UpPromote — affiliate and ambassador program management.
  • Payment processors and fulfillment and shipping providers — to take payment and deliver your orders.

5.4 Your choices

  • Cookie preferences. Manage non-essential cookies through our cookie banner or the "Cookie Preferences" link in our footer.
  • Your Privacy Choices. Use the "Your Privacy Choices" link in our footer to opt out of the sale or sharing of your personal information for targeted advertising.
  • Global Privacy Control. If you visit our website with the Global Privacy Control opt-out preference signal enabled, we will treat this as a request to opt out of sale and sharing for the device and browser you use to visit the website. If we are able to associate the signal with an account, we will apply the opt-out to that account as well. Other than Global Privacy Control, we do not recognize other "Do Not Track" signals that may be sent from your web browser or device.
  • Platform controls. Use the ad-settings links in Section 5.2 to control personalization within each platform.

Opting out of personalized advertising does not mean you will stop seeing advertising. It means the advertising you see may be less relevant to you.


6. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf — including IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping, email and text message delivery, subscription management, and reviews.
  • With advertising and marketing partners — including Meta, Google, and TikTok, to provide marketing services and advertise to you, as described in Section 5. These partners will use your information in accordance with their own privacy notices.
  • With creators, affiliates, and influencer platforms — in connection with our product-seeding, affiliate, and ambassador programs. We share only the information necessary to deliver a product order to a participating creator. Content that creators publish about our products is public and is governed by the terms of the platform on which it is posted.
  • When you direct, request us, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger, acquisition, or bankruptcy; to comply with any applicable legal obligations, including responding to subpoenas, search warrants and similar requests; to enforce any applicable terms of service or policies; and to protect or defend the Services, our rights, and the rights of our users or others.

Sale and Sharing for Targeted Advertising

Several state privacy laws define "sale" and "sharing" broadly, to include disclosing personal information to advertising partners for cross-context behavioral advertising even when no money is exchanged. Because we use the advertising technologies described in Section 5, the following applies:

  • Categories we share, and may "sell" as defined by those laws: identifiers, including hashed email addresses and phone numbers, cookie identifiers and advertising identifiers; device and usage information; transaction information; and inferences.
  • Categories of third parties receiving that information: advertising and analytics platforms — specifically Meta, Google, and TikTok.
  • We do not sell, rent, or lease your personal information to data brokers or marketing list aggregators, and we receive no monetary payment for it.
  • We do not knowingly sell or share the personal information of consumers under 16 years of age.
  • We do not sell or share consumer health data, and we do not use consumer health data for targeted advertising. See Section 8.

You may opt out at any time using the "Your Privacy Choices" link in our website footer, by enabling Global Privacy Control in your browser, or by emailing admin@proleanwellness.com.


7. Email and Text Message Marketing

If you provide your email address or mobile phone number and opt in, we may send you marketing communications.

Email. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders you have made.

Text messages. We send marketing text messages only with your express written consent. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Consent to receive marketing text messages is not a condition of any purchase. We do not share mobile opt-in data or consent with third parties for their own marketing purposes.


8. Consumer Health Data Privacy Notice

This section applies to residents of Washington, Nevada, and Connecticut, and constitutes our Consumer Health Data Privacy Policy for purposes of the Washington My Health My Data Act.

Because we sell dietary supplements and wellness products, some information we collect may be considered consumer health data — information that identifies your past, present, or future physical or mental health status.

Categories of consumer health data we collect. Supplement and wellness product purchase and browsing history; responses you provide to our supplement-matching tool; wellness goals or interests you choose to share with us; subscription selections; product reviews concerning your own experience; and inferences we draw from this information about your wellness interests.

Sources. Directly from you when you shop, complete our supplement-matching tool, subscribe, submit a review, or contact us; and automatically through your interactions with the Services.

Purposes of collection and use. Solely to fulfill your orders, manage your subscriptions and account, provide customer support, meet product-safety and recordkeeping obligations, recommend products within our own store, and comply with law.

Who we share it with. Only with service providers and processors who need it to perform these functions on our behalf — such as payment processing, order fulfillment, and subscription management — under contracts requiring them to protect it and prohibiting them from using it for their own purposes.

What we do not do.

  • We do not sell consumer health data. Under the Washington My Health My Data Act, any sale would require your separate signed authorization. We do not seek such authorization because we do not sell this data.
  • We do not use consumer health data to target advertising to you on Meta, Google, TikTok, or any other platform.
  • We do not use consumer health data to create audience segments that are shared with advertising platforms.
  • We do not collect precise geolocation information that could indicate an attempt to acquire health services or supplies.

Your rights regarding consumer health data. You have the right to confirm whether we collect, share, or sell your consumer health data and to access it; to withdraw your consent to its collection and sharing; and to request that we delete it. If you request deletion, we will delete your consumer health data from our records and notify our processors to do the same, subject to narrow exceptions permitted by law.

How to exercise these rights. Email admin@proleanwellness.com with the subject line "Consumer Health Data Request." We will respond within 45 days, which may be extended by a further 45 days where reasonably necessary, in which case we will notify you. If we decline your request, you may appeal by replying to our response, and we will decide the appeal within 45 days.


9. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

10. Third Party Websites, Links, and Social Platforms

The Services may provide links to websites or other online platforms operated by third parties, and we maintain a presence on third-party platforms including Facebook, Instagram, TikTok, and YouTube. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions.

We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. When you interact with us on a third-party social platform, that platform collects and processes your information under its own privacy policy, and we have limited control over that processing.

Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.


11. Notice of Financial Incentive — Rewards and Subscriptions

Our rewards program offers benefits including 10% back in rewards on qualifying orders, and our subscribe-and-save program offers discounted pricing on recurring orders. Because participation involves the collection of personal information, these programs may be considered a "financial incentive" under California law.

  • Information collected. Contact details, account information, and transaction history necessary to track, calculate, and apply your rewards and manage your subscriptions.
  • How to opt in. By creating an account and enrolling in the program.
  • How to withdraw. Contact us at admin@proleanwellness.com at any time. If you withdraw, you may forfeit any unredeemed rewards balance.
  • Material terms. Rewards accrue on qualifying purchases and may be redeemed against future orders in accordance with the program terms published on our website.
  • Good-faith estimate of value. We have made a good-faith estimate that the value of the personal information collected through these programs is reasonably related to the value of the benefits offered, calculated by reference to the expected cost to us of the rewards and discounts provided to participating customers. Participation is entirely voluntary, and declining to participate does not affect the price or quality of the products otherwise available to you.

12. Clinic and Supplement Data Integrity Addendum

Separation of clinical records. Prolean Wellness maintains a strict separation between retail e-commerce customer records and confidential patient health databases. Private medical intake files and clinical consultation notes are not transmitted to, stored within, or processed by our Shopify supplement platform. Protected health information created by the Prolean Wellness clinic is governed by HIPAA and by the clinic's separate Notice of Privacy Practices, not by this Privacy Policy. Being a patient of the clinic does not enroll you in store marketing, and we do not use clinical records to target advertising to you.

Our commitment to you. Prolean Wellness is a practitioner-owned wellness brand. We have never sold, rented, or leased your personal contact information, email address, or purchasing history to data brokers, marketing list aggregators, or any third party seeking to monetize it. We have never accepted payment of any kind in exchange for your personal information, and we never will. Your information is not a revenue stream for us.

What we do instead, and what the law calls it. Like nearly every online retailer, we advertise on Meta, Google, and TikTok, and we use those platforms' standard measurement tools so that we can understand which advertising actually works. To do this, limited information — such as a hashed version of your email address and which pages you viewed — is transmitted to those platforms. No money changes hands, and we receive nothing in return except advertising measurement and delivery. However, California and several other states define "sale" and "sharing" broadly enough to cover this activity. We would rather tell you plainly than rely on a technicality: under those legal definitions, we do share and may "sell" your information for advertising purposes, and you can switch this off at any time using the "Your Privacy Choices" link in our footer.

What we never do, in any circumstance. We do not sell your personal information to data brokers or list aggregators. We do not sell or share consumer health data. We do not use clinical records for advertising. We do not target advertising based on health conditions. And we do not accept payment for your personal information.


13. Children's Data

The Services are intended for adults aged 18 and over. Dietary supplements are not intended for children, and we do not direct our Services or our advertising to minors.

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" — as those terms are defined in applicable law — the personal information of individuals under 16 years of age.


14. Security and Retention of Your Information

We maintain administrative, technical, and physical safeguards designed to protect your personal information. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on the purpose for which we collected it, our legal obligations, and whether we need the information to maintain your account, provide you with Services, resolve disputes, or enforce other applicable contracts and policies. We apply the following criteria:

  • Contact details. Retained for the duration of your customer relationship with us, and afterwards for as long as necessary to service your account, meet product-safety and warranty obligations, and comply with legal, tax, and accounting requirements. Where contact details are linked to an order, they are retained for a minimum of six years in order to satisfy dietary-supplement adverse-event recordkeeping requirements.
  • Financial and transaction information. Retained for a minimum of seven years for tax and accounting purposes. Full payment card numbers are held by our payment processors and not by us.
  • Account information. Retained until you delete your account, plus a short period necessary to complete deletion across our systems and backups.
  • Marketing contact details and consent records. Retained until you unsubscribe or withdraw consent. A minimal suppression record, such as a hashed email address, is retained indefinitely so that we can continue to honor your opt-out and avoid contacting you again.
  • Device, usage, and advertising data. Typically retained for 24 months or less, in line with the retention settings of our analytics and advertising providers.
  • Consumer health data. Retained only for as long as necessary for the purposes described in Section 8, and deleted upon verified request.
  • Privacy request records. Retained as required by applicable law in order to demonstrate our compliance.

We periodically review inactive records and remove marketing contacts who have been unengaged for an extended period.


15. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

  • Right to access or know. You may have a right to request access to personal information that we hold about you, including the categories collected, the sources, the purposes, and the categories of third parties to whom we disclose it.
  • Right to delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Right to limit the use of sensitive personal information, where applicable in your jurisdiction.
  • Right to opt out of sale or sharing for targeted advertising. See Section 6.
  • Right to non-discrimination. We will not discriminate against you for exercising any of these rights.
  • Right to appeal. If we decline your request, you may appeal that decision by replying to our response. We will respond to your appeal within the period required by the law of your state.
  • Managing communication preferences. See Section 7.

How to exercise your rights. Use the "Your Privacy Choices" link in our website footer, or contact us using the details in Section 18. We may need to verify your identity before we can process your request, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf. Before accepting such a request from an agent, we will require that the agent provide proof that you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

16. Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or to lodge a complaint with your local data protection authority.


17. International Transfers

Please note that we may transfer, store and process your personal information outside the country you live in.

If we transfer your personal information out of the European Economic Area, the United Kingdom, or Switzerland, we will rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority, unless the data transfer is to a country that has been determined to provide an adequate level of protection.


18. Changes to This Privacy Policy, and How to Contact Us

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date, and provide notice as required by applicable law.
